Abstract:
This paper provides the first large-sample multidimensional econometric evidence on the heterogeneity of inter-temporal flows of invention value anticipated by inventors, and on their correlation with externalities recognized by subsequent patentees, as implied by citations in their patents. Our study uses a new data set on data of Chinese-US patent dyads, exploiting Chinese inventors’ choices to apply for invention patents, utility models (cheaper, with faster grant but shorter life), or both. We show that the applicant’s choices at the Chinese patent office reveal their ability to anticipate and respond to heterogeneity in intertemporal private value flows, which appear to be correlated with intertemporal variation in externalities indicated by citations in subsequent patents. Integrating the decision about utility model or invention patent at the Chinese patent office with the renewal decisions at the U.S. office, and adding forward citation as well as variation in patent prosecution strategies including changes of claims, we present a far richer, more comprehensive and nuanced depiction of variation in inter-temporal patent value flows than can be inferred from renewal data alone.
